Privacy Policy

Below is the privacy policy (hereinafter, the “PRIVACY POLICY”) that governs the processing of data carried out through the platform -currently named- “BuyLatam” (hereinafter, the “PLATFORM”), owned by BUYLATAM B2B S.A., domiciled at Calle 518 N° 1765, between 12 and 13, in the town of Ringuelet, Partido de La Plata, Province of Buenos Aires (hereinafter, the “COMPANY”).
PURPOSE
The COMPANY recognizes the importance of privacy and of protecting the personal data of PLATFORM users (hereinafter, the “USERS”) and undertakes to process such data in accordance with applicable personal data protection regulations. Accordingly, the purpose of this PRIVACY POLICY is to inform USERS of the manner in which the COMPANY processes and protects personal data and privacy, in order to guarantee their right to honor and privacy, as well as access to information that may be recorded on the PLATFORM.
DEFINITIONS
For the purposes of this PRIVACY POLICY, the terms “personal data”, “sensitive data”, “database”, “data processing”, “database controller”, “computerized data”, “data subject”, “data user” and “data dissociation” shall have the meaning assigned by Article 2 of the Personal Data Protection and Habeas Data Law No. 25,326 (hereinafter, the “LPDP”).
PERSONAL DATA PROTECTION PRINCIPLES
The COMPANY complies with all personal data protection regulations, in particular the LPDP, its Regulatory Decree No. 1558/01 and supplementary regulations (hereinafter, the “PERSONAL DATA PROTECTION REGULATIONS”). Likewise, where applicable according to the jurisdiction of residence of the personal data subject, the COMPANY adopts reasonable measures to comply with local or international regulations applicable to personal data protection. Notwithstanding the foregoing, the COMPANY complies with all principles arising from the PERSONAL DATA PROTECTION REGULATIONS, including but not limited to: (i) the principle of legality, given that the COMPANY's databases containing personal data are duly registered with the National Registry of Databases; (ii) the principle of quality, given that the COMPANY only collects personal data that is necessary and appropriate for the provision of its services and use of the PLATFORM, and does so through fair means and respecting the privacy of the holders of such personal data; (iii) the principle of purpose, given that the COMPANY uses the personal data collected solely for the purpose for which it was collected; (iv) the principle of informed consent, given that the COMPANY obtains the consent of personal data subjects in the manner prescribed by the LPDP whenever necessary, except where one of that law's exceptions applies; and (v) the principles of security and confidentiality of information, through the use of advanced technology that adequately safeguards -according to the state of the art- the confidentiality and security of information. Likewise, to guarantee data security, the COMPANY will apply the same criteria and the same degree of diligence it applies to safeguard its own information.
AUTOMATED COLLECTION OF PERSONAL DATA
The PLATFORM may automatically collect personal data. It may also access geolocation, USERS' contact data, and data provided through third-party integrations or tools. The PLATFORM also uses cookies. Cookies are small pieces of data stored in the USER's browser that provide the COMPANY with information about USER activity. Information collected through cookies will be used by the COMPANY to improve the PLATFORM. USERS can delete or disable cookies through their browser settings, but this may prevent them from accessing some sections and/or features of the PLATFORM, or may alter their experience with the PLATFORM, in whole or in part.
COLLECTION OF PERSONAL DATA
The PLATFORM may require the USER to enter personal data. In such case, the USER represents and warrants that all personal data provided will be true, complete and up to date. Accordingly, the USER agrees to hold the COMPANY harmless and free from any liability for any penalty and/or claim and/or damage that may arise as a result of failure to comply with the above representation and warranty. The COMPANY's personal data collection forms contain the provisions required by the LPDP, particularly regarding informed consent for the collection of personal data. The data subject is responsible for the truthfulness and accuracy of the information provided therein, and assumes responsibility for keeping such information up to date. The COMPANY may use specific validation measures on forms to verify that (i) they are not completed automatically without direct and immediate USER involvement, and (ii) the USER meets the requirements or has the qualities necessary to register and/or provide the required personal data.
SENSITIVE DATA
Under no circumstances will the COMPANY automatically collect or require the provision of sensitive data.
EXERCISE OF DATA SUBJECT RIGHTS
In order to exercise the rights of access, update, rectification or deletion regarding their personal data -and any other right recognized by applicable regulations- PLATFORM USERS must send an email to info@buy-latam.com, indicating the reason for contact and reliably proving their identity. Once the identity of the data subject has been verified, the COMPANY will allow access and/or the exercise of other rights, free of charge, at intervals of no less than 6 (six) months, unless a legitimate interest is proven for that purpose, and under the terms set out in the LPDP.
RETENTION PERIOD
The COMPANY will retain the information collected while the relationship with the USER remains in effect, and for the corresponding statute-of-limitations periods under the regulations in force in the Argentine Republic.
AMENDMENTS TO THE PRIVACY POLICY
This PRIVACY POLICY may be amended by the COMPANY in order to adapt it to applicable legal and regulatory provisions. Amendments will be published on the PLATFORM and take effect on the same day they are published, unless otherwise stated.

CONTROLLING AUTHORITY
USERS may file complaints with the competent data protection authority of the jurisdiction corresponding to their place of residence or applicable regulations. For example, in the case of the Argentine Republic, the Access to Public Information Agency, as the LPDP's controlling authority, is empowered to address complaints and claims filed by those whose rights have been affected by non-compliance with regulations in force regarding personal data protection (https://www.argentina.gob.ar/aaip).
